Did the Data Center Quietly Rewrite Your Town's Noise Rules? I Went Looking for the Paper Trail
Under a news video about a data center humming around the clock in Michigan, the top comment says what everyone's thinking: if that noise came from a house, the owner would be fined into oblivion. A reply underneath offers the theory I set out to test — that the company probably rewrote the municipal code to exempt itself before it ever poured concrete. So I went digging through county records and news archives to catch someone doing exactly that. What I found is older and stranger than a backroom deal.
The theory: they exempted themselves before they broke ground
It's a satisfying theory. A company that size has lawyers, the town has a part-time council, and the building went up fast. Of course somebody slipped a clause in.
I couldn't find a single case of it. Not one noise ordinance, anywhere I looked, rewritten at a data center company's request before construction. And I looked in the places where you'd most expect to find it — Loudoun and Prince William counties in Virginia, where more of these buildings sit near homes than anywhere else on Earth.
What I found instead is that the rules didn't need rewriting. They were already shaped to let the hum through, some of them long before anyone in that county had said the words 'data center' out loud. The quiet code change is real. It just happened in the other direction — as things left out, not things put in.
The exemption was already sitting in the code
Prince William County's noise code had a nighttime exemption for heating and air conditioning equipment. Which made sense when it was written — nobody wants their neighbor's window unit to become a police matter in July. Then data centers showed up, and their cooling plants — whole walls of industrial fans and chillers running all night, every night — walked in through the same door as somebody's rooftop AC. On paper, the loudest thing for miles was an air conditioner, and air conditioners got a pass after dark. The supervisors finally closed that loophole in early 2023. Then a fight broke out over what to replace it with, and the version that eventually passed was one critics said offered residents only minimal relief.
The other decision that happened before the building did is zoning. In a lot of counties, a data center is a 'by-right' use on industrial land — if the parcel is zoned industrial, the company can build without a public hearing. The meeting where you could have objected happened years before you moved in, and the agenda item was a line on a map with no building attached to it. One commenter under a Virginia news video asked why zoning laws didn't stop a data center from going up near homes. In these counties, zoning is the reason it could.
The meter that can't hear the hum
Here's the part that actually answers the question. Almost a decade ago, Loudoun County rewrote its noise rules after Virginia's Supreme Court threw out a similar ordinance for being too vague. The rewrite landed before the wave of resident complaints — the code change really did come before the trouble did. And this summer a Virginia news outlet dug through the staff records from that rewrite and found something I can't stop thinking about: when the question came up of also regulating tonal noise — the steady, narrow-band drone that is precisely the sound a data center makes — staff estimated it would cost about $1,000 in software and training. The county passed.
So Loudoun measures noise the way most of America does, in A-weighted decibels — a scale built around how human ears hear mid-range sound at conversation volume. It discounts deep bass hard. The data center hum sits down around the lowest string of a five-string bass, in a register the scale is designed to shrug off. The county's meter listens the way a phone speaker plays music: all the deep stuff politely missing.
Which is how you get the fact that broke my theory for good. In a single year, Loudoun logged a dozen formal complaints about one data center campus. Violations found: zero. The people in those yards weren't imagining anything. The instrument doing the judging was tuned for a different sound.
The towns that moved before the concrete truck
It doesn't have to go this way. Chandler, Arizona wrote data center rules a few years back — noise studies and mitigation required before approval, after an earlier facility there had residents comparing the sound to mosquitos and watching their windows rattle. Fairfax County tightened its zoning rules too, before its residential areas filled up with server halls. The pattern holds everywhere I looked: towns that wrote rules before the building got protections, and towns that wrote them after got lawsuits.
Dowagiac, Michigan is the after. The city set industrial noise limits once the facility was already humming, then fined the operator for blowing past them. The operator's answer was to offer to buy the nearest houses. That's what a fine is worth against a building that earns more in an hour than the penalty costs.
So no — I never found the villain rewriting the code in a back room, and I want to be straight that I looked. The quiet code change turned out to be a skipped $1,000 software upgrade and a zoning map drawn before broadband existed. Somebody always ends up living on the other side of a decision like that, and lately it's people who can hear their living room.
