Has Any Town Actually Stopped a Data Center? Yes — And Here's How They Made It Stick

Short version: yes. In the last year alone, a few ordinary town councils looked at data center projects worth billions and voted them down — and a couple made the no actually hold. What got me was how they did it. Not a big rally speech, not a lawsuit, but a change to the zoning code most people never read.

The vote everyone celebrates isn't where it's won

Tucson is the one that went viral. Around a thousand people packed the meetings, signs up, and in August the city council voted 7-0 against Project Blue, a data center campus tied to Amazon. People cheered in the room. It looked finished.

Then it came back. Pima County went ahead and approved the land sale and the rezoning, and the state utility commission cleared a way to power it. The council's no turned out to be a speed bump, not a wall. So the loud vote you see on the news is real, but it's rarely the thing that actually decides it.

Where it actually gets decided: the paperwork nobody reads

The town that made it stick did something almost boring. Peculiar, Missouri had quietly slipped "data center" into its light-industrial zoning as an allowed use. When residents pushed back, the board didn't just vote down one project. It deleted those two words from the code. Now there was no legal slot for a data center to sit in, and a project worth well over a billion dollars had nowhere to go.

That's the pattern everywhere it held. In Chesterton, Indiana, town officials and residents lined up until the developer withdrew on its own. Other places bought time with a moratorium, a few months to write real rules on noise, on water use, on how far a site has to sit from your bedroom window. Set the night-time noise limit low enough and push the setback far enough back, and the math on the site quietly stops working.

The town holds cards it doesn't know it's holding

Here's the part that changed how I read these fights. The company needs a yes from the town, usually several of them. It needs land rezoned. It often needs to be annexed into the city just to reach the water. It wants a tax break. Every one of those is a vote, and a vote can go no.

Water was Tucson's lever. The site had to be pulled into the city to get water service, and the developer more or less admitted that no water meant no project. And people keep asking the reasonable question I had too: don't these things just recirculate the water like a gaming PC? Some of the heat does loop around. But the big AI sites often lean on evaporative cooling, which burns through water for real, and a large campus can drink like a small town on a hot afternoon. So when a town controls the tap, it's holding more than it thinks.

Then there's the bill. In areas packed with data centers, residents are watching their power rates climb, which is why this fight keeps pulling in people who agree on almost nothing else. The question sitting under all of it is plain: who pays for the wires and the water, the town or the company?

So, could your town do it?

Maybe. The ones that pulled it off didn't out-argue a trillion-dollar company. They found the one yes it couldn't skip — the zoning line, the water hookup, the annexation — and they said no right there, in writing, in a way that's hard to walk back.
