Can a Town Just Shut Off a Data Center's Water and Sewer to Block It?

I always figured the fight over a data center was a zoning fight — the noise, the land, the blinking lights. Then a utility outside Detroit did something sneakier. It went after the tap. For a full year, no new data center in its service area can get hooked up to water or sewer. Which made me wonder: can a town actually do that? So I went digging, and the answer turned out to be a lot messier than a clean yes.

What the utility near Ypsilanti actually did

The Ypsilanti Community Utilities Authority — the outfit that pipes drinking water and hauls away sewage for a chunk of Washtenaw and Wayne counties — voted in April 2026 to stop the clock. Twelve months, no new water or sewer service committed to any data center, AI computing facility, or high-performance computing site. The township next door had asked them to do it a week earlier.

What set it off wasn't a hunch. There's a University of Michigan research data center on the table worth over a billion dollars, plus a separate billion-dollar proposal nearby. One of those facilities, by a U-M engineer's own estimate, could pull up to half a million gallons of municipal water a day. Picture that as enough to keep a small town showered every morning — going into one building full of chips.

The utility figures it has a cushion of maybe five million gallons a day of spare sewer room. Two big data centers could swallow most of it at once. So instead of arguing the point project by project, the board just closed the valve on the whole category and said: give us a year to run the studies we haven't updated since 2018.

Why the water tap is a different weapon than zoning

Here's the thing I didn't get at first. I assumed water was just zoning wearing a different hat. It isn't. It's a separate chokepoint, and it might be the stronger one.

A data center can't run without water and a place to send it. A building full of servers gets thirsty the same way a marathon runner does — it sweats to keep from cooking, except its sweat is your tap water, evaporating off the cooling towers. Zoning you fight one application at a time, one variance, one lawsuit. The water hookup is closer to a single light switch. No pipe, no data center. That's exactly why the utility reached for it.

And it answers a question I saw people asking over and over: can't a company just shrink the project, or split it into a cluster of smaller buildings, to slip under the rules? Against a zoning threshold, maybe. Against a flat 'no new hookups for this whole category,' the water and sewer line doesn't care how many buildings you break it into. Underneath all of it is a fight over math nobody trusts. The utility figures roughly half the water a data center takes comes back as wastewater. Outside experts I read put the return closer to twenty or thirty percent — the rest just evaporates and is gone. When the master plan is from 2018 and the estimates swing that wide, the real question isn't who's allowed to say no. It's who has to pay for the upgrades if the answer is eventually yes — the company that wants the pipe, or every household already on it.

What I keep landing on is that this whole thing is a stall, not a wall. The town near Detroit didn't kill the data center. It hit pause and dared everyone to argue about the numbers in daylight, before the pipe gets committed instead of after.
